PRIVACY POLICY

EVOLVE MODERN PILATES LLC

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from evolvemodernpilates.com (the "Site"), when you use the Evolve mobile application on Apple and Android mobile devices (the "App"), and when you book or attend classes at our studio. The Site, the App, and our studio services are referred to together as the "Services."

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device to power our site analytics, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as "Device Information." We share this information with Squarespace, our website analytics provider, to learn about site traffic and activity.

Additionally, when you make a purchase or attempt to make a purchase through the Site or the App, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as "Order Information." We share this information with Squarespace (our online hosting provider), Mariana Tek (our class booking platform), and Stripe (our payments processor) so that they can provide services to us.

When you create an account, book a class, or attend a class, we collect information related to your participation, including your class reservations, check-in and attendance history, membership or class package balance, and class and instructor preferences. We do not ask you to submit medical or health information in order to create an account or book a class. Our liability waiver does ask you to tell your instructor about any physical or mental condition that would affect your participation. If you choose to share such information with an instructor or with studio staff, we may record a brief note on your account so that we can modify exercises for you safely in future classes. We refer to all of this information as "Health and Fitness Information." It is described in its own section below.

When you use the App, we or our platform provider may collect app usage and diagnostic information, such as app version, device type, operating system version, crash reports, and in-app activity, to keep the App working correctly.

When we talk about "Personal Information" in this Privacy Policy, we are talking about Device Information, Order Information, and Health and Fitness Information together.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site or the App, including processing your payment information, arranging for shipping, and providing you with invoices and order confirmations. Additionally, we use this Order Information to:

Communicate with you;

Screen our orders for potential risk or fraud; and

When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud, in particular your IP address, and more generally to improve and optimize our Site, for example by generating analytics about how our customers browse and interact with the Site and to assess the success of our marketing and advertising campaigns.

HEALTH AND FITNESS INFORMATION

We collect and use Health and Fitness Information to operate the studio and the App. Specifically, we use it to reserve your place in class, check you in, apply visits against your membership or class package, communicate with you about your bookings and attendance, show you your own class and attendance history in the App, and maintain the records required by our liability waiver, terms of service, and insurance.

Any note recorded on your account about an injury, limitation, or other condition you have told us about is used for one purpose only, which is to help instructors modify exercises for you safely. We do not require it, we do not use it to make decisions about pricing or membership, and you can ask us to remove it at any time by emailing privacy@evolvemodernpilates.com or telling us in the studio.

We do not sell Health and Fitness Information. We do not use it for targeted or behavioral advertising, and we do not share it with advertising networks, data brokers, or social media platforms for advertising purposes.

We share Health and Fitness Information only with the service providers that operate our booking platform and mobile application (Mariana Tek) and our payment processor (Stripe), each of which processes it on our behalf under contract and is not permitted to use it for its own purposes, and with our instructors and studio staff to the extent needed to serve you safely in class. We may also disclose it where required by law, as described under Sharing Your Personal Information below.

WEARABLE AND HEALTH PLATFORM DATA

The App can read workout metrics from Apple Health on iOS and from Health Connect on Android, but only if you turn this feature on and grant permission on your device. The App requests read access to two data types: heart rate and active energy burned.

If you grant access, the App reads only the values recorded during the scheduled start and end time of a class you were checked in to, and displays them to you on your reservation details, reservation history, and stats screens. You can choose to display both metrics, one of them, or neither in the App's health settings.

These values are read on your device, displayed to you, and then discarded. They are not transmitted to Evolve Modern Pilates or to Mariana Tek, are not stored on our systems or theirs, and are not included in any analytics, reporting, marketing, or advertising. They are never sold or shared with any third party. Studio staff and instructors cannot see your heart rate or active energy data. The App never writes any data back to Apple Health or Health Connect.

You control this access at all times. You can revoke permission through iPhone Settings on iOS or through the Health Connect app on Android. Once revoked, the App stops reading any further data and your metrics stop appearing. Because this data is never stored, there is nothing for us to delete when you revoke access.

Data obtained from Apple Health or Health Connect is used solely to provide the features described in this section. It is not used for any advertising, marketing, or data mining purpose, and it is not disclosed to third parties for those purposes.

SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information as described above. We use Google Analytics to help us understand how our customers use the Site. You can read more about how Google uses your Personal Information here: https://www.google.com/intl/en/policies/privacy/. You can also opt out of Google Analytics here: https://tools.google.com/dlpage/gaoptout.

We do not sell your Personal Information, and we do not share Health and Fitness Information, wearable data, or SMS consent data with third parties for their own marketing or promotional purposes.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

BEHAVIORAL ADVERTISING

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Health and Fitness Information and data read from Apple Health or Health Connect are excluded from this use. For more information about how targeted advertising works, you can visit the Network Advertising Initiative's educational page at http://www.networkadvertising.org/understanding-online-advertising/how-does-it-work.

Additionally, you can opt out of some of these services by visiting the Digital Advertising Alliance's opt-out portal at: http://optout.aboutads.info/.

DO NOT TRACK

Your browser settings may allow you to automatically transmit a "Do Not Track" signal to online services you visit. Note, however, there is no industry consensus as to what site and app operators should do with regard to these signals. Accordingly, unless and until the law is interpreted to require us to do so, we do not monitor or take action with respect to "Do Not Track" signals. For more information on "Do Not Track," visit http://www.allaboutdnt.com.

YOUR RIGHTS

You may request access to the personal information we hold about you, and you may ask that it be corrected, updated, or deleted. To make a request, email privacy@evolvemodernpilates.com. We will respond within the time required by applicable law. We may need to verify your identity before acting on a request, and we may retain information we are required to keep for legal, tax, or insurance reasons.

If you are a resident of California or another state with a comprehensive privacy law, you may have additional rights, including the right to know what personal information we collect and how we use it, the right to request deletion, the right to correct inaccurate information, and the right not to be discriminated against for exercising these rights. We do not sell personal information and we do not share it for cross-context behavioral advertising in the sense those terms are used under California law.

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below. Additionally, if you are a European resident, we note that we are processing your information in order to fulfill contracts we might have with you, for example if you make an order through the Site, or otherwise to pursue our legitimate business interests listed above. Please note that your information will be transferred outside of Europe, including to the United States.

ACCOUNT AND DATA DELETION

You can request deletion of your account and the personal information associated with it at any time by emailing privacy@evolvemodernpilates.com from the email address on your account, or by asking the studio front desk. Upon request we will delete your account, profile information, class history, and marketing contact information.

We may retain a limited set of records where we are required or permitted to do so by law, including transaction and payment records retained for tax and accounting purposes, signed liability waivers retained for the period required by our insurer, and records needed to resolve disputes or enforce our agreements. Heart rate and active energy data read from Apple Health or Health Connect is never stored by us, so no deletion request is necessary for it.

Deleting your account will end your ability to book classes through the Site or the App and may affect any active membership or class package.

DATA RETENTION

We retain Order Information and Health and Fitness Information for as long as your account is active and for as long as we need it to meet our legal, tax, and insurance obligations, unless and until you ask us to delete it. We retain Device Information for the period set by our analytics providers. We do not retain heart rate or active energy data read from Apple Health or Health Connect, because that data is displayed on your device and discarded rather than stored.

SECURITY

We use commercially reasonable administrative, technical, and physical safeguards to protect your personal information. Information transmitted between the Site or the App and our service providers is encrypted in transit, and payment card information is handled by Stripe, a PCI-DSS compliant payment processor. Access to member records is limited to studio staff who need it to do their jobs. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

MINORS

The Services are intended for adults. Our Waiver of Liability requires each participant to be at least eighteen (18) years of age, and accounts on the Site and the App are intended to be created and held by adults. A minor may participate only where a parent or legal guardian has assented to the Waiver of Liability on the minor's behalf and holds the account.

We do not knowingly collect personal information directly from children under the age of 13. If you believe a child under 13 has provided us with personal information, contact us at privacy@evolvemodernpilates.com and we will delete it.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons. When we make material changes, we will update the "Last Updated" date at the top of this page.
